The only way a judge is throwing it out is if it's a legit medical/prescription based reaction or there's some sort of technicality. Can't imagine it being anything recreationally drug related. Perhaps schizophrenia as well
There was no Judge involved. The DA determined there was insufficient evidence to proceed. Proving malice would be difficult and without witness cooperation , determining monatary damages would be as well.
