The Constitution says it's the Senate's duty to accept or reject a SCOTUS nominee. Obama could've played hardball and threatened to force Garland onto the court if the Senate wouldn't vote to reject him. But he figured it wasn't worth it because he expected Hillary to win.
Obama could have chosen to make Garland a recess appointment to the court. Then we'd have had a functional Supreme Court for the last year. He should have done that. When history looks back at Obama it will say that he was naive about how the political process works when he entered the Presidency and that he wasn't ruthless enough to overcome that later on. The recess appointment was a no-brainer as soon as the GOP Senators who controlled the process made it clear there would be no hearings for a year until after the election. Obama should have just smiled and waited for an unguarded moment and seated Merrick until the term expired.
