minimum penalty for NY state - criminal possession of a weapon in the fourth degree - a class A misdemeanor. Penalties include up to one year in prison. It could be escalated to criminal possession of a weapon in the second degree - a class C felony A further charge of reckless discharge of a weapon could be added. EDIT: in New York there's a mandatory 3.5-year sentence if he was not in legal possession of the gun. The NY Post reports that Plax did not have a permit in New York and his license to carry in Florida expired in May.
Plax is doing the smart thing right now - not talking to the police. The longer he waits the more time goes by and any evidence / accounts of the incident get lost. Marshawn Lynch did the same thing when he was drunk and hit a pedestrian. Eventually the charge became some minor traffic infraction. If he had stopped the cops would have charged him with DUI.

The press reported the hospital where Plaxico was treated did not inform the cops about the injury. I thought that was standard procedure - if there's a gunshot wound, the cops are automatically notified. Anybody who works in a hospital (or is a spouse to one that does) can you comment on this ?
Plaxico Burress is due a $1 million roster bonus on December 10, according to SI's Peter King. There's next to no chance that Burress will get it. Since it's a roster bonus, Plax would have to be on the 53-man team to receive it. The Giants might place him on the non-football/injury list before that date so they don't have to pay him. You know what, I'm gonna give him a pass on this. He's a dumbass sure...but he caught the pass that beat the Cheatriots so he's been alright with me ever since. That was the most excited I have ever been after a win that didn't involve the Steelers. So Plax can shoot himself all he wants, but he helped beat the "best team ever." For that I'll always be grateful.
Well at least the Jets only shot themselves in the foot figuratively... Man, Plax has always been a little suspect but he's become a grade A headcase since getting the ring and new contract (not neccesarily in order of importance)
