Schumer did not say the Senate should not hold hearings and not vote. He said if W submitted another nominee like Roberts or Alito, clear right wing partisans both, then such a nominee should not be confirmed. And the GOP Senate has already been blocking Obama's ability to put judges on the US Courts of Appeal for the last year or so. Bush named 60 such judges, and Obama has only been able to place 48. No false equivalency here, please. The Supreme Court has not gone without full membership as long as this will amount to I think since the Civil War.

lol- a 79 year old fat man with a history of heart troubles dies of a heart attack. That's not that shady/surprising. He was "in the middle of nowhere" because he was on a planned hunting trip. His family didnt want an autopsy and the government leaders in the area basically granted their wish. being embalmed less than a day later isn't that surprising either if the family had both money and previous end of life plans. He was 79. The death of a 79 year old man in his sleep is not unusual. Also, why would Scalia be the person assassinated in this situation? Assuming that you think this was a Liberal conspiracy it would make more sense to assassinate the much younger John Roberts and open up the Chief Justice-ship and a seat for filling by the presumed Liberal conspiracy that would somehow get anybody appointed in the next year. If you think it was a Conservative conspiracy then any of the women sitting on the Supreme Court would have been a better target. Ruth Bader-Ginsburg would have been an easy age-related target and both Elena Kagan and Sonia Sotomayor would take young Moderate-Liberal seats and put them up for grabs. If a Liberal conspiracy wanted to pack the court somehow they'd have assassinated Roberts or Scalia a year ago, making a successful Obama nomination an inevitability of the process. If a Conservative conspiracy was the answer they'd have waited until just before the election and then done their dirty work. The Supreme Court had 4 Justices 77 years or older sitting at the time of Scalia's death. The odds on one of the 4 of them dying this year were reasonable.
Not when the President is a Moderate Democrat and the House is controlled by Conservative Republicans with a Liberal Democrat minority and the Senate is controlled by Conservative Republicans with a Moderate Democrat minority. The Constitution wasn't written with the notion of political parties as the dominant power groups in play. It was written to empower the elite to make all the decisions without interference by the masses. Andrew Jackson basically upset the applecart and we've been dealing with the mess ever since.
