You can re-tender... Typically the 1st and a 3rd goes to just a 1st or just a 2nd depending on interest level.
And if I'm the owners, I'm mentioning that possibility to try to motivate the discussions. Still, I'm not sure the NFLPA buys the argument. A shortened FA period with a ton of free agents means the top end ones have rapid competition for their services, and it's more likely that a team overpays. Of course, that also means less money for the lesser FAs.
in a semi related note: i dont see how there could be a free agency, or a hard cap year without a new cba before the draft. there has to be an uncapped year in 2011...especially if this shit drags into the summer.
Why not? If it's in our best interest, or if we drafted at the position, we could very well take a lesser trade. Look at Leon. He was tendered at a 2nd, no one expressed interest, and he was eventually traded for a 5th.
The only way there will be an adjusted cap is if we're moving to an 18 game season. At that point, we'll need an adjusted cap until after the first 18 game season in 2012 can determine revenue and the new percentages can be applied. Otherwise, there's not much reason why a hard cap based on the new percentages of revenue can't be applied. Teams are already cutting overpaid contracts in anticipation of one.
It doesn't get used much but then it doesn't make sense to use it. Since teams can sign draft picks for for years draft picks usually don't become RFAs in a normal capped year, and when they do the highest tender of a first and a third usually drives teams away. Likewise the cost of a non-exclusive franchise tag is so high (two firsts) that most teams won't bother trying to sign a player, and if a player is so valuable that they might be worth two firsts (like Peyton Manning) their team usually uses the exclusive franchise tag which prohibits them from going to another team. The seahawks got screwed by a poison pill if I remember.

Of course. That would just require talks to drag out more than another month and a half. Given the state they're in now, it's starting to seem awfully likely that the draft will come first. Could be the most fascinating draft ever if that's the case. As WW85 pointed out earlier, contracts can't be signed after March 4th. That means the draftees would be getting contracts alongside free agents unless the near-inevitable rookie scale gets put down. You're going to see a lot of pissed off agents if that happens, which I'll love.
It's certainly possible, IMO. Smith's versatility is valuable and just might be valuable enough to pay a 2nd for. probably a 3rd tho.

also. going along with this mess of rookies not being able to negotiate deals until the new CBA is put in place, since coaches and current players can't get together to work and figure out how to learn new systems, or delve deeper into playbooks, what the hell is going to happen to rookies? People are freaking out about new system changes (most often used example is Sam Bradford being unable to learn Josh Mcdaniels system) what about the team that drafts Cam Newton to be the face of their franchise and expects him to start day 1? The guy won't even get to look at a playbook until august for crying out loud. Anybody else starting to think the quality of play next year is going to by absolutely terrible for the first few months of the season?
It's just an option on what pick a player it tendered at. You are not allowed to tender a player at any round you want, so besides the limited options you have (upper round picks) you can tender them at their original draft position as well, whatever that pick was. The available rounds to tender a player at are a 1st and 3rd, a 1st, a 2nd, or the original draft position.
