Yeah that's funny, but what happens when they are shooting at me? There are way too many illegal handguns in this country to ever even consider banning handguns. Might as well walk barefoot through sandspurs. And where in the hell is Hobbs? That little pansy's been ducking me all week.
That's how plea bargains work. You save the prosecution time by agreeing to plead guilty to a lesser charge than the one with which you were originally charged. The name is really irrelevant, the degree (ie. 6th degree) of the crime and the nature (firearm) are what really matter for legal purposes.
I'm no lawyer, but I agree. Pleading to a lesser charge entails that that crime was indeed committed. It wasn't just attempted, it happened. If there were such a fantasy charge as "weapons possession without intent to use", then that would be a possible plea down. You can't plea down to attempted murder if you actually are proven to have killed someone. Manslaughter maybe, but not attempted murder. Attempted weapons possession would be an inaccurate charge.
Three showers a week???!!! That is GROSS. Pacman had much worse crimes...so did Vick...so did Leonard Little. Yet they are all free to roam the earth...does not make sense.
It does make sense. I suspect if Vick, Pacman or Little walked into a club in NYC with a gun and shot themselves they would be in jail. I don't see any problem with that at all. That's what States rights is all about.
Here is my problem with this. When it first happened there were stories that just about everybody who did this and had no prior convictions were able to plea down to something where they spent 6 months in jail. Then Bloomberg got involved and talked about mandatory 3 year sentences..blah..blah...blah..and all of a sudden the best he could get was a plea down to 2 years. Without the publicity I don't think he would ever have gotten what he did. For the same reason I think it will get commuted after 6 months or a year at most.
Always learn a lot from your posts...but this is just wrong. In 2008 Plax was standing at the White House, joking with the Prez and holding the Lombardi trophy. He was also visiting the patients at Walter Reed, doing community service. Plax is a good citizen, his brain is just on backwards. He blew off a 35 mill contract, because he is STUPID and stubborn/disrepectful in the locker room. Bloomberg is just being a total control freak & not using good economic judgement. If Bloomberg would let Plax out of the slammer to train & play for the JETS as a WR, it would greatly increase the revenue of New York. Then Plax can go back to the slammer at night. Instead, the taxpayers are going to spend a ton of cash to keep Plax locked up. What a waste of a great talent & athlete.
He needed a gun for protection as a high profile football player in the nation's largest market. However, he also needed a large, imposing person to follow him around and CARRY that gun. There's no excuse for someone making that much money not having a bodyguard if he wants to enjoy the nightlife.
I read your post, didn't ignore it, grasped your concept. I wasn't sure whether this was your opinion or fact. Like I said, I'm no lawyer. I've never been in trouble with the law. Maybe you are a lawyer or have experience in the court system. If so, I trust you. Perhaps I should have entered my post more as opinion than fact because it's really just what I think happens/should happen, that's my error. I'm probably wrong. It happens all the time. I knew you could plea down, but I thought it had to be like you said, a lesser degree of something that happened, not just a few details of what happened. To me attempted weapons possession is not a lesser degree of weapons possession, its completely different. If what you said regarding only degree and nature mattering is true, then so be it. But I did read and comprehend your post.
I have experienced it as wellas as seen friends go thru it. From simple things like how Jersey'll let you talk to a prosecutor and plea a speeding ticket ($200 state charge +points) to "failure to obey traffic sign" ($400 local charge with no points). It was win-win, where I got no points and the town got way more money for themselves. and the charge i plead too can be construed as meaningful in that situation although speeding was not mentioned and that's what I really did. I knew a guy that sold hash to a narc in Albany, and he ended up pleading down to public nuisance, a $50 dollar fine. Another guy I know plead a possessions charge to disorderly conduct, NY again. So it really isn't that hard to see how they'd let PB plea down to attempted possession from actual possession. And when u think about it, he DID attempt to possess a weapon, just because the attempt was successful doesn't mean the former is any less true. P.S. Sorry bout the attitude, just that the tones of our posts were similar, and I did have some firsthand knowledge on this one.
Its alright, come to think of it I have seen people plea a speeding ticket down to things like "improper muffler". Doesn't make any sense to me, but oh well.
