    Maybe Bergdahl was just asking his Taliban neighbors for a glass of pop/soda. Either way if those terrorists weren't living in fear he wouldn't have been there anyway

    Apparently you and your buddy Bellows are the ones who don't understand what they are talking about. One does not forfeit his Constitutional rights when he is a member of the Armed Forces of the United States. The same constitutional protections military members are fighting to preserve are afforded to them. The system of justice is indeed the UCMJ and that is based upon the same constitutional protections that civilian courts are. You embarrass yourselves when you make claims to the contrary and try to argue your preconceptions with someone who has lived under the UCMJ.

    Whatever Bergdahl was doing, his motivation, his state of mind and any possible penalty will be determined by a court of law based upon the protections afforded him by the Constitution of the United States of America regardless of the uninformed opinions of those who, no doubt, picture themselves as bastions of patriotism while walking all over that same Constitution.

    Are you also one who believes he can treat the Constitution like a cafeteria and pick and choose those parts they choose to live with and flush the rest?

    Every single word of the UCMJ is based on the principles of the Constitution. No one in any court is tried under the constitution but every court in these United States, including every military court, operates under the precepts of the Constitution.

    Do you actually think or propose that any court in the US should not? That might be the most un-American thought ever proposed anywhere.

    Go ahead, disagree, but do it by showing what safeguards of the Constitution are not requireded by the UCMJ.

    I don't have the time or patience to spoon feed you so I'll just give you a few of the basic precepts off the top of my head of Constitutional rights exhibited in the UCMJ.

    Presumption of innocence.

    The right to face one's accuser.

    Trial by jury.

    The right to appeal.

    You could look the rest up if you weren't afraid to open your narrow mind a bit.
