They'll have forensics based on range, angle of entry, etc. I think the prosecutor is going to have at least an even chance at a conviction. If he shot her from twenty feet away from an oblique angle maybe it looks more likely that he might have accidentally shot her thinking she was an intruder. If he shot her from a head on angle or the rear but from under ten feet away that is going to be a tough sell to the jury.
I'm trying to imagine a scenario in which his gf would enter in such an abnormal fashion that would cause him to think "must be an intruder" instead of "hmm...maybe that's my girlfriend"
