It's more subtle than that. The defense wants the death penalty off the table before the trial begins because it probably feels that this will increase the defendant's chances of being found not guilty. Here's why: In a capital case, the jury that will decide both guilt or innocence and whether to impose a death sentence must be "death-qualified." That means the judge must disqualify any potential juror who has strong scruples against the death penalty and could never vote to impose a death sentence. Defense attorneys believe that death-qualified juries are more likely to find a defendant guilty, regardless of what sentence is ultimately imposed. They feel that juries that are not death-qualified are more likely to acquit. In short, the defense probably feels that taking the death penalty off the table before trial increases the defendant's chances for an acquittal.
They have released the 911 call transcript, and some text messages between the roommates. It’s strange , during the 911 call, no one speaks of any blood in what was said to be a bloodbath. They call 911, saying it seems they passed out drunk and won’t wake up, but no one went in and actually tried to wake someone up? Where they would have noticed what happened
Yeah, some things about this are just not adding up. I don’t see how at this point, but maybe it will be cleared up at trial. So, the surviving roommates were frantically texting , terrified at 430am…. Saw a masked man, then just went back to bed for 8 hours? Hmmmmm Pretty sure that at that point, 8 hours later , you’re gonna go check on one of the roommates, and most likely see the one that was lying on the floor at the doorway, and even more likely…. Notice a bloodbath. But no mention of blood on the 911 call? Just “they are passed out and not waking up?” This makes no sense. No freaking way that 8 hours later gap is explained away. Neither checked on any of them… friends came over, atleast one did check enough to tell the operator no breathing…. Didn’t notice blood that was enough to seep out of the house? WTF? My first assumption at the beginning of this, was that the 8 hours was used to scrub the house if drugs etc before 911 was called. And friends were there much earlier. 8 hours later, there is gonna be an odor of blood with 4 people butchered .
The 911 audio has been released. I guess it clears some things up. Seems that one of the boys that were called over to the house around 11am, was the one to actually go up and check on Ethan/xana. In the audio you can hear he can’t clearly enter the room (door locked, body blocking door?). So that may explain why the girls didn’t see anything . He must have saw what happened , and came back downstairs and kept it calm for the girls sake (assumed). Still doesn’t explain why, for 8 hours they were that concerned yet never called 911. And didn’t go check on roommates themselves. If you were that scared that you could t check, then you would most likely call 911(not 8 hours later, while being scared enough to bypass bedrooms and go directly outside). You can hear their fear on the call. So there was nothing nonchalant about what they thought may be going on.
I dont think they just sat there for 8 hours though thinking about what to do. They passed out. It was the middle of the night they were probably drunk, passed out and woke up 8hours later right? that seems possible to me
Yeah, that’s about all that would make sense. They seemed pretty freaked out during the 430 am texts , but then again, no chance a kid that age would suspect something like that.

Dateline covered the Idaho case last night and it did have some new stuff the evidence is so strong, idk how anyone can think he should get off after seeing that also I’m not a big death penalty guy but I think he deserves it

I watched this last night finally. Interesting they ended with the defense claiming an “alternate suspect”. Watch them try an pin it on Brent kopacka , the guy swat killed in Pullman shortly after. Obviously a very disturbing case from the start, but it really grabbed me when they went through how he supposedly went through the house. And how he chased xana, and she put up a fight. The extra cruelty to Ethan. Just kids, and completely defenseless .
I don’t know anything about that Kopacka guy I’ll look him up but yeah it’s ridiculous ya know after watching that I think the media has treated this Koberger guy with kid gloves. They briefly mentioned in this show that he was a heroin addict. Like wait what? A heroin addict brutally stabs 4 people and why are we hearing about his college grades and shit they carried on about for most this time. Talk about grades? The one victim graduated early yet we have to hear about the 30 year old “college student” druggie/murder’s grades instead Not to mention most media circles have focused on the drug and alcohol activities of the victims!
