Exactly. This isn’t a long tenured loyal assistant looking to move on to promote his career and being sent off by his school with the best of wishes. Folks that think like that are either naive or don’t want to accept this is big business.
I agree with you in saying the Cards job is not appealing... They're in one of the top 2 divisions in the league IMO which will be hard to overcome with their roster. I do think KK would at least get an NFL OC position but with the consistently changing NFL who knows.
Rollo, what is laughable with some of these posters comments who it seems by the comments, know little of nothing about running a multimillion dollar business (which USC is BTW) is why would you want this guy who would sign a contract and then jump ship two months later... There is something called loyalty and trust which in this dialogue seems to be missing. We do not need another unproven HC.. we need stability and creditability which Mac brings.
Most none competes are an employer requirement and have nothing to do with the employee agreeing to it or not. These clauses in most cases are nothing more than restraint of trade in most cases. They are based on protecting proprietary information that an employee has gotten because of their employment. If they are being used to hold your pay down they are clearly being used to restrain trade which is against the law. In this case the candidate hasn't gotten any proprietary information as a result of his work at USC that needs to be protected. The reason he can't interview is the NFL requires permission because the NFL has a huge vested interest in protecting NFL contracts. One of the way contracts are protected is by suing people and companies for interfering in contracts. USC is using the NFL rule and it's very likely to make USC a very unattractive place for talented people to contract with in the future. USC is dumb as shit to restrain Kingsbury, it's a huge public relations blunder. The idea that teams want to promote him to steal proprietary information that was only available because of his work at USC is insane. The only basis to restrain him is interference with an in place contract. That's being enforced by the NFL not USC. If you wanted to leave your employer because of a better higher paying job and your employer restrained you from doing it based on that reason and you weren't pissed, you're a complete tool. If they were restraining you for competitive reasons that's a different story. That doesn't apply here.
USC really has no say. The only thing their ‘block’ accomplishes is try and force a speedy resolution. They insist on ‘blocking’ him, and force KKs hand to resign and pursue the NFL jobs. The flipside is KK doesnt resign, still pursues the NFL jobs and doesnt get one and stays at USC.. or he is offered one and week or 2 later he resigns and USC is in the same position anyways. Contracts mean very little in football.... players, coaches....
Again, you are confusing the question that was asked of me with a tangential issue. Believe me, I understand what restraint of trade is and all of the illegalities of it. My non-compete has to do with direct competitors and the uniqueness of my business and our equity play. I understand that USC and the Jets are not competitors. That wasn't the question.
I actually think it has very little to do with loyalty and trust. They signed him for very specific reasons. To freely let him walk 2 months later because "hey, you've been a good employee, we'd never block you from bettering your career" is infantile.
Except the NFL has decided to enforce an old rule and if the Jets or AZ or anyone else is determined to have defied the rule and interviewed him without getting permission--they are going to get docked draft picks and/or fined Of course nothing can stop back channel talks but he either has to quit (and pay whatever penalty is in his contract) or he has to get permission to interview.
This move is going to set back USC sports for years. The AD will be canned over this incredibly dumb move.
As a former NY living in AZ I would say if you're an ambitious person in your prime making a high income the metro NY area is far superior to AZ. If you have a wife and kids in school the metro NYC area has a lot more to offer. If you're really a top guy it's not even close. If you win in NYC you have a lot more opportunities to turn the HC gig into commercial success worth millions more. Sort of the Cherry on top. There is no question that for top professionals in almost any field NYC is one of, if not the place to be.
Lynn Swann may get fired but it will be for sticking with Clay Helton, not for blocking a new hire from using USC as a stepping stone 2 months after signing up. They hired Kingsbury to jump start JT Daniels career and to help recruit the kid from Hawaii. If Daniels excels, Helton stays. Swan letting Kingsbury out of his contract would effectively be cutting out his legs from under him. JMHO.
