JPP Sues ESPN, Schefter for posting pics of his nubs

    i think the bigger issue is how schefter was able to obtain the records if jpp didn't sign off on it.

    He coerced some hospital technicians to take photos and text them. Those two people got suspended and recently fired and the hospital is under some red tape too

    I dont know all the legal mumbo jumbo behind this stuff but how is this any different then when guys like Schefter release info about any other NFL players injury? Because a picture is involved?

    JPP didnt lose any money from his stupidity , and now is trying to gain more money from it?

    Why would hipaa law apply to Schefter? I think he’s morally wrong, but I don’t think he’s legally culpable. Shouldn't his grievance be with the hospital and staff?

    Let the lawyers figure that out. Involve as many deep pockets as possible (the Hospital AND ESPN)

    Schefter could probably get into legal trouble if he paid the hospital workers for the photo.

    Or if he instigated the hospital worker into getting them.

    But if he was contacted by the workers of their own account, I'm not sure Schefter has any duty to JPP--I don't believe he's bound by any HIPPA laws just because he came into possession of medical records.

    And quite frankly, I'm ok that he tweeted out the pic.

    Reporters aren't bound to HIPPA laws so Schefter is probably okay.... unless he paid for the file... that's a different story.

    The hospital though is fucked. Even if JPP himself isn't going after them the feds will. Its a HIPPA violation for someone merely looking at his file that shouldn't be. This happened to UCLA medical center when celebrities were complaining that hospital personnel were looking at their files and the feds nabbed them with a heavy fine. Pulling the file out and taking a picture of it for a reporter????? that's not only worthy of a harsher fine but jail time honestly.

    not to mention the original tweet had information from some random 70 year old woman on top of JPPs. terrible.

    If it comes out that Schefter paid for the photo, JPP will win in the civil case and honestly ESPN should fire Schefter. If he didn't pay for it and someone from the hospital voluntarily gave him the info he & ESPN will be fine but either way IMO it was some national enquirer-esque trash and they should've never tweeted that out. They need someone with some professionalism there to stop bullshit like this. It might turn out to be legal but that doesn't mean its ethical or professional.

    Do you have any links or facts to back this up? Or is this your normal "I heard" bullshit.

    I'm not a big Shefter fan, but he doesn't seem to have any history of doing this TMZ type thing.

    It's also being discussed in radio that even though espn and Schefter were not at fault of hipaa violations but FL state law requiring a waiver to post medical records from patient. They didn't do that.

    How else could he get the image ? It had to be coerced to prove his news story he was reporting. He takes texted image and tweets it. Stop being dense....you know these news guys do what it takes to sell a story. Let's see if $$ changed hands. Let me ask you, you don't think in this day and age of instant media, Schefter didn't sniff around for some fish to get some proof of the amputation? When the details of this new suit come out ....we'll hear more about the 2 people fired at the hospital. I doubt these 2 people went running to the sidewalk looking for Schefter

    I think they were probably being opportunists, and found someone willing to pay for the photos. He should have known better no doubt.
