I'm sure the Br*dy texts will leak. My guess is a hacker who is a fan of another team (possibly one of us) already has them and is waiting for an opportune time. Possibly when the suspension is lifted post appeal or during Monday night football the week before his return.
This is the NFL not a murder trial. This is more likened to a civil suit and there was more than enough evidence presented to show Br*dy was complicit.
Truth is an absolute defense to libel (written) and slander (spoken). A preponderance of the evidence is all that is required as the standard of proof in this civil lawsuit. That means that all that has to be proven is that it is MORE PROBABLE THAN NOT that Brady cheated. Oh, and the libel and slander cases are much harder to prove when dealing with a public figure like Brady. This is not happening.
So, If T*m filed in oh, I don't know...Massachusettes you don't think he could get a jury to go 51% in his favor? The NFL has branded him a liar, a cheat and taken 4 million dollars from him, without any actual proof. I don't think they can make him give up his phone or use anything from the other phones without his permission. The other 2 guys are not facing any charges, there's no reason for them to talk (hush money). I haven't seen anywhere that either of them were told by T*m to let any air out of the balls. It didn't acually sound like either of them liked T*m. Of course the NFL, could well have the proof, showed it to Br*dy and told him to take the punishment without complaint. And they may well have lawyers smarter than me that already considered all this. I just wanna see Goodell and the P*ts/Br*dy/Kr*ft going at each other in public for a while longer.
I'm not one to defend T*m Br*dy in anyway, but if you snap chatted a pic of your cock and sent it to other dudes, would you want your phone looked at? And would you want anyone to look thru your emails when they are filled with Gay Date Requests? I'm just saying. There's good reason why he didn't want to share his phone and emails with the investigators.
But can br*dy prove it's not true? Is he willing to release his cellphone records to build a case that the NFL is unjustly causing harm to his name?
I too love the drama and the level of indignation and lack of accountability coming out out Chowdahland is astounding, but there is no chance he will sue for defamation or libel. He's more likely to sue under some claim of lacking Due Process or the collective bargaining agreement, but even that appears slim as he would first have to go through appeal, and then maybe arbitration.
they met the specific burden of proof that all NFL teams, including the Patriots, agreed apply to this type of infraction, a preponderance of the evidence.
