no, under .08 doesn't mean not under the influence or impaired. the moment you have a drink you are under the influence and impaired, and the higher your BAC the higher your level of impairment. .01 is under the influence and impaired, just to a lesser extent. .08 is simply the measure of legally drunk, not a decree that anything less is not under the influence or impaired.
