Perhaps the pick they already traded was the Saints pick and we're getting their actual 5th round pick.
Again... There's no reason this would be a part of the trade. In situations where teams owe a fifth round pick and don't have a fifth round pick, they must surrender a fourth round pick. Or a third round pick, if they don't have either. If they have a fifth round pick, they surrender... drumroll, please... A FIFTH ROUND PICK!
Well heres the thing its a conditional pick. So if the NFL (or whoever decides on conditional picks) decided that the eagles had to give up their 5th round pick, and the eagles have a lower pick well they arent equal. A conditional pick means you give up or get whatever is awarded.

I believe the conditions of the trade for the Jets to surender their 4th and recieve the Eagles 5th was based on Shepherd play 80% or 85% of the defensive snaps this season. Considering he hissed 5 games due to injury this season, I am not sure if playoff games are included in calculating this season's stats but I doubt it. If somehow the trade conditions are met and we do have to surrender out 4th round pick, then the Eagle will owe us thier 5th round pick or the next best pick they have. I am not sure when the time line would be when the Jets own the pick. At some point it would have to be awarded to the Jets so that the Eagles couldn't trade the 4th pick to someone else for thier 5th (assuming that is lower then their own was) and a 6th or 7th.
The conditions on the Lito Sheppard trade are final. The Jets must send a 2010 fourth-rounder to the Eagles, who must return a fifth rounder. Actually, the conditions as laid out by NY Daily News only specify "A" fifth round pick, not the Eagles fifth round pick. So if those are the legal terms, I don't think the OP is correct.
