Now that we have seen what they took from his apartment, when would they release the findings of the tests on the hair, stains etc? Trial? Also wondering about the car, and what they may have taken from the house in pa. I’m thinking he had his most important items with him there.
Gag order on Moscow Murders Trial extended to all attorneys who are party to the case including attorneys for the victims and their families. There is already a gag order for all law enforcement officials involved in the case. This is probably long overdue at this point. The social media problem is still an enormous overhang over the credibility of a fair trial. Not sure how they're going to handle this because so much bullshit is being flung around that the air is streaked in brown.
There is going to be a graveyard of discredited “journalists “, when this is over. Looks like even people magazine even hopped on the bs train, claiming to have info from a former restaurant employee, that Bryan had ordered a few times. I’ll also add, that this town, and from what I’ve read , the state likes to sit within a shroud of silence. Unfortunately for them, the story has gone national, and even worldwide. They have gone as far as putting out misleading info, and told local businesses etc to do the same. Both sides are fueling eachother.
Whatever else you think Kohberger has a right to a fair trial and due process under the law. If he had any means to speak of the injunctions against various web sites and YouTube channels would be flying right about now. There are some sites that are putting out content almost daily designed to paint him in the worst possible way. Free speech is important but the right to a fair trial is just as important. The court doesn’t want to restrict free speech beyond the professional realm it has direct oversight upon but it may have to stretch out and start doing some very edge of the law type stuff if the hanging jury at large keeps profiting off of the story. That would have enormous consequences at the local, state and federal levels and would make the murder trial a temporary sideshow as it played out. Kohberger might remain incarcerated for years before the trial actually commenced.
It took you guys two months and 18 pages of publically speculative musings on the subject to land on the conclusion that publically speculative musings on the subject are a bad thing. Way to go.
Exactly!!! Although I was more looking at the sites that are attempting to drum up views for monetization purposes and cross-pollinating. It's a really tricky situation to be in for everybody. Not quite at the yelling FIRE!!! in a crowded movie theater level but definitely something we will have to collectively look at moving forward. Until about 15 years ago it was possible to transfer the venue to avoid the effects of pre-trial publicity. Those days are gone under the current rules in play. There's no place in the USA you could move this trial and not have it extensively tainted by pre-trial publicity.
I think the thing that most surprising to me, is that previously thought credible journalists or sources , have also jumped on the -whatever it takes for some clicks - train.
Nancy Grace has been a hanging judge in her reporting for years but she really hates Kohberger. Either that or she has calculated that hating on him is the best way to monetize the situation.
There's a local guy who fits TypeO's description almost to a T. Also seen in the vicinity of a couple of the victims the night of the murders. Not going to name him.
If they end up having the right guy …”just above(typical) college age, local, outcast , could be right too, no?
I think the authorities are going to do something fairly unprecedented in terms of the information being disseminated about Kohberger. The proprietor of the Mad Greek restaurant in Moscow went ballistic over reports that Kohberger had ordered vegan pizzas there on two occasions and stood out to the staff in the process. She said to her knowledge Kohberger had never been in the establishment. She said the report had caused a lot of trouble and extra work for investigators, herself and her employees, presumably as the authorities were forced to chase their tails trying to track down the veracity of the story. Basically she called bullshit on the story and requested that the pubic listen only to things confirmed by the authorities moving forward. She was calling out social media as dangerously uninformed in the process. Free speech is a guaranteed right but when it turns into obstruction of justice it can also be a crime.
I also wonder if the circus is actually good for the case. The farther it goes from the reality of the case, they actual facts will be a surprise during trial.
The thing that is interesting to me is that as the actual evidence is measured and seems less and less certain the social media frenzy gets looser and looser adding new and almost completely inconsequential items to try to make the defendant look guilty. This is almost like some kind of compensating effect coming into play. All of the 'evidence' on Kohberger's social media contacts both before and in the timeframe of the case is basically bupkus, largely not traceable directly to him and of questionable value even if traced back. The evidence provided by his classmates and professors is completely circumstantial, often hearsay and is of the quality of townsfolk discussing a witch. The direct claims, like Kohberger went to the Mad Greek twice, ordered vegan pizza and fixated on Maddie Mogen are turning out to be pure fabrication when the investigators try to clarify them. I think we're 50/50 at this point that the judge orders the charges dropped at some point because the 'evidence' is just not there for a capital trial and it's part of the judge's responsibility to set a floor on what can cause this type of event.
I think the majority of this case is behind the scenes. They either have a ton more, or things didn’t materialize as they hoped. The Wa search warrant was released in Wa, where they have much more transparency. I believe what they took from the house in pa, was sent directly to Idaho, where it’s kept under their wraps. I really hope they have what they need, because if he is the guy and gets off, it is not the guy.. the odds they ever solve this goes very low.
At the moment absent a confession the case probably hangs on what the evidence from his apartment and car turns into. Circumstantial evidence from the scene is going to be less valuable because of the timeframe of the report after the crimes were committed. Eyewitness testimony is going to be shaky for the same reason. The receipts they found in his apartment are circumstantial but they’re also a big deal because they may prevent the defense from putting Kohberger on the stand.
He’s guilty as fuck and they have a ton of evidence I guess OJ and Casey Anthony got off so you can’t say anything is a lock but damn
If you’re the defense why wouldn’t you just say yeah of course he’s been there - everyone parties at that house? And let them try to prove he never attended a party at a clear party house. I think he did it because he was a loner and didn’t seem like a party guy on top of clearly following and engaging the girls on social media. But unless they have blood DNA at the scene or the murder weapon, it’s very circumstantial.
The really interesting question is whether Kohberger will take the stand in his own defense. If the defense really believes he has nothing to hide and the prosecution can’t find an easy to understand motive to go alongside all the circumstantial evidence it’s going to be hard to get a conviction. You’d have to find a jury who had never had a hard to understand young male relative in the family to sell some of the far fetched motives floating around right now.
Wonder what’s gonna happen with this “conflict of interest”, with the defense attorney. Apparently, she has represented 3 family members of the victims, and was currently representing xanas mom until she withdrew Jan 5. A few attorneys I’ve seen speak on it, said she should have stuck with the existing relationship. She has/had power of attorney on xanas mom.
