Even as Hillary Clinton tries to put questions about her private email server behind her, the FBI has stepped up inquiries into the security of the former secretary of state's home-made email system and how aides communicated over email, POLITICO has learned.

The FBI’s recent moves suggest that its inquiry could have evolved from the preliminary fact-finding stage that the agency launches when it receives a credible referral, according to former FBI and Justice Department officials interviewed by POLITICO.

“This sounds to me like it’s more than a preliminary inquiry; it sounds like a full-blown investigation,” said Tom Fuentes, former assistant director of the FBI. “When you have this amount of resources going into it …. I think it’s at the investigative level.”

The FBI declined to respond to questions about the scope of its ongoing work.

But POLITICO learned that around early October, the FBI requested documents from a company involved in the server arrangement after Clinton left State. It also interviewed a former high-ranking policy official at State about the contents of top Clinton aides’ emails.

The official, who spoke to POLITICO on condition of anonymity, said the questions explored whether anyone at State was concerned about classified information being put at risk by communicating via email. The source did not know of any such concerns.

Confirmation of the interview and document requests is the first public indication that the agency is moving ahead with its inquiry – and possibly expanding it.

The former State official interviewed by the FBI, for example, had little to do with the Clinton server set-up or any approval process allowing her to use personal email for work — suggesting the FBI’s initial inquiry about the actual physical security of Clinton’s home-made server now also includes looking at the content of messages shared by staff.

Former FBI and Justice officials familiar with the investigative procedures on such matters said the agency must determine two main things: whether the use of an outside email system posed any risks to national security secrets and, if so, whether anyone was responsible for exposing classified information.

FBI Director James Comey acknowledged in October that his agency was probing the server matter generally and believed it had the resources to look into the issues, though he didn't give specifics.

Over the summer, the Department of Justice said it received a referral from the Intelligence Community Inspector General about potentially exposed classified information on Clinton’s home-made email server. The referral, Justice said at the time, was not criminal in nature but focused on the counterintelligence law governing national security secrets.

The matter at the time was considered a “preliminary” inquiry.

Clinton’s campaign and lawyers have said they are cooperating, turning over her server and a thumb drive backup of her messages to the FBI. They’ve also said they’re encouraging everyone who worked on the server issue to do the same. Platte River Networks, the Denver-based company that housed her server since she left State in 2013, for example, has said it’s cooperating; so has Datto, another tech company that provided a cloud backup of Clinton’s messages.

But exactly who they’re talking to at the staff level has been unclear. For example: Cheryl Mills, Clinton’s former chief of staff at State and lawyer who helped determine which of her emails were personal and work related, wouldn’t say in a recent Washington Post interview whether she had been contacted due to confidentiality surrounding the FBI’s work.

The FBI ultimately decides whether to take a preliminary inquiry to a full-fledged investigation — and if it does so, it is under no obligation to say so publicly. The classification level of any compromised information "may be a factor in determining whether an FBI investigation is warranted," reads an overview of FBI procedures.

In its review of Clinton's emails, the State Department has classified more than 400 messages so far — materials that would not therefore be allowed on a homemade email system, although Clinton has said that none of them were marked classified at the time she or her staff received or sent them.

POLITICO reported on Friday that some of the original messages that triggered the referral — a couple messages the ICIG said were "top secret," the most sensitive national security material — were no longer considered that protected.

Sources told POLITICO this week that as of a month ago, the Justice Department had not determined how to proceed with Bryan Pagliano, Clinton’s top IT expert who oversaw her server but took the Fifth and refused to answer questions when subpoenaed by Congress earlier this year.

Republican lawmakers have weighed an immunity agreement for Pagliano, which would bar him from prosecution and allow him to talk about what he knew of the server: who approved it, why and the security surrounding the system.

His lawyer, reached Thursday, would not confirm whether he’s even been contacted by the FBI.

The agency has asked for documents from Tania Neild, the New York-based technology broker for millionaires, who put the Clintons in touch with Platte River Networks.

Neild confirmed the FBI request in an interview with POLITICO, saying the agency asked her to appear with written documents relating to the advice she gave to her client about negotiating with Platte River. Her company, InfoGrate, acts as a middle man between high-worth individuals and companies that oversee their personal technologies, such as emails.

Neild operates under a confidentiality agreement with all her clients. She said the nondisclosure arrangement precluded her from cooperating with the Senate Homeland Security Committee, which is also investigating the server issue and reached out to her for an interview. But the FBI notice, she said, trumped her confidentiality agreement.

Her lawyer would not confirm any contact they may or may not have had with the Department of Justice or the FBI.

“What we did receive were inquiries from [the Senate Homeland Committee] that are looking into various things,” said Ron Safer, of Chicago’s Schiff Hardin. “And whether we have had communications with anybody else, I really can’t say at this point.”

Due to secrecy surrounding any FBI investigation, it is impossible to know exactly where the FBI stands. And since the issue involves the 2016 Democratic front-runner, the work is even more sensitive.

Ron Hosko, former assistant director of the FBI’s Criminal Investigation Division, said Justice is likely worried about issuing formal legal notices “because they know it will get out, and then you’re talking about a grand jury investigation.” But he said it’s “not uncommon” for companies to require subpoenas, court orders or other legal notices to cooperate to save their corporate reputation, which could otherwise be jeopardized for sharing personal information.

“I am sure there is hand-wringing and gnashing of teeth across the street at the Hoover Building because you’re going to have people saying ‘I don’t want to produce X documents. Give me a piece of paper that covers me.’ And that’s where push is going to come to shove,” Hosko said.

The FBI has expanded its probe of Hillary Clinton's emails, with agents exploring whether multiple statements violate a federal false statements statute, according to intelligence sources familiar with the ongoing case.

Fox News is told agents are looking at U.S. Code 18, Section 1001, which pertains to "materially false" statements given either in writing, orally or through a third party. Violations also include pressuring a third party to conspire in a cover-up. Each felony violation is subject to five years in prison.

This phase represents an expansion of the FBI probe, which is also exploring potential violations of an Espionage Act provision relating to "gross negligence" in the handling of national defense information.

"The agents involved are under a lot of pressure and are busting a--," an intelligence source, who was not authorized to speak on the record, told Fox News.

The section of the criminal code being explored is known as "statements or entries generally," and can be applied when an individual makes misleading or false statements causing federal agents to expend additional resources and time. In this case, legal experts as well as a former FBI agent said, Section 1001 could apply if Clinton, her aides or attorney were not forthcoming with FBI agents about her emails, classification and whether only non-government records were destroyed.

Fox News judicial analyst Judge Andrew Napolitano said the same section got Martha Stewart in trouble with the FBI. To be a violation, the statements do not need to be given under oath.

"This is a broad, brush statute that punishes individuals who are not direct and fulsome in their answers," former FBI agent Timothy Gill told Fox News. Gill is not connected to the email investigation, but spent 16 years as part of the bureau's national security branch, and worked the post 9/11 anthrax case where considerable time was spent resolving discrepancies in Bruce Ivins' statements and his unusual work activities at Fort Detrick, Md.

"It is a cover-all. The problem for a defendant is when their statements cause the bureau to expend more time, energy, resources to de-conflict their statements with the evidence," he said.

Separately, two U.S. government officials told Fox News that the FBI is doing its own classification review of the Clinton emails, effectively cutting out what has become a grinding process at the State Department. Under Secretary for Management Patrick Kennedy has argued to both Director of National Intelligence James Clapper and Congress that the "Top Secret" emails on Clinton's server could have been pulled from unclassified sources including news reports.

"You want to go right to the source," Gill said. "Go to the originating, not the collateral, authority. Investigative protocol would demand that."

On Friday, Clapper spokesman Brian Hale confirmed that no change has been made to the two "Top Secrets" emails after a Politico report said the intelligence community was retreating from the finding.

"ODNI has made no such determination and the review is ongoing," Hale said. Andrea G. Williams, spokeswoman for the intelligence community inspector general, said she had the same information. Kennedy is seeking an appeal, but no one can explain what statute or executive order would give Clapper that authority.

A U.S. government official who was not authorized to speak on the record said the FBI is identifying suspect emails, and then going directly to the agencies who originated them and therefore own the intelligence -- and who, under the regulations, have final say on the classification.

As Fox News previously reported, at least four classified Clinton emails had their markings changed to a category that shields the content from Congress and the public, in what State Department whistleblowers believed to be an effort to hide the true extent of classified information on the former secretary of state's server.

One State Department lawyer involved in the alleged re-categorization was Kate Duval. Duval once worked in the same law firm as Clinton's current and long-time lawyer David Kendall and at the IRS during the Lois Lerner email controversy. Duval left government service for private practice in mid-September.

EXCLUSIVE: The FBI investigation into Hillary Clinton’s use of private email as secretary of state has expanded to look at whether the possible “intersection” of Clinton Foundation work and State Department business may have violated public corruption laws, three intelligence sources not authorized to speak on the record told Fox News.

This new investigative track is in addition to the focus on classified material found on Clinton’s personal server.

"The agents are investigating the possible intersection of Clinton Foundation donations, the dispensation of State Department contracts and whether regular processes were followed," one source said.

The development follows press reports over the past year about the potential overlap of State Department and Clinton Foundation work, and questions over whether donors benefited from their contacts inside the administration.

The Clinton Foundation is a public charity, known as a 501(c)(3). It had grants and contributions in excess of $144 million in 2013, the most current available data.

Inside the FBI, pressure is growing to pursue the case.

One intelligence source told Fox News that FBI agents would be “screaming” if a prosecution is not pursued because “many previous public corruption cases have been made and successfully prosecuted with much less evidence than what is emerging in this investigation.”

The FBI is particularly on edge in the wake of how the case of former CIA Director David Petraeus was handled.

One of the three sources said some FBI agents felt Petraeus was given a slap on the wrist for sharing highly classified information with his mistress and biographer Paula Broadwell, as well as lying to FBI agents about his actions. Petraeus pleaded guilty to a misdemeanor in March 2015 after a two-plus-year federal investigation in which Attorney General Eric Holder initially declined to prosecute.

In the Petraeus case, the exposure of classified information was assessed to be limited.

By contrast, in the Clinton case, the number of classified emails has risen to at least 1,340. A 2015 appeal by the State Department to challenge the “Top Secret” classification of at least two emails failed and, as Fox News first reported, is now considered a settled matter.

It is unclear which of the two lines of inquiry was opened first by the FBI and whether they eventually will be combined and presented before a special grand jury. One intelligence source said the public corruption angle dates back to at least April 2015. On their official website, the FBI lists "public corruption as the FBI's top criminal priority."

Fox News is told that about 100 special agents assigned to the investigations also were asked to sign non-disclosure agreements, with as many as 50 additional agents on “temporary duty assignment,” or TDY. The request to sign a new NDA could reflect that agents are handling the highly classified material in the emails, or serve as a reminder not to leak about the case, or both.

"The pressure on the lead agents is brutal," a second source said. "Think of it like a military operation, you might need tanks called in along with infantry."

Separately, a former high-ranking State Department official emphasized to Fox News that Clinton’s deliberate non-use of her government email address may be increasingly “significant.”

“It is virtually automatic when one comes on board at the State Department to be assigned an email address,” the source said.

“It would have taken an affirmative act not to have one assigned ... and it would also mean it was all planned out before she took office. This certainly raises questions about the so-called legal advice she claimed to have received from inside the State Department that what she was doing was proper."

On Sunday, when asked about her email practices while secretary of state, Clinton insisted to CBS News’ "Face The Nation," "there is no there, there."

We have confirmed "Top Secret" emails that were definitely on her private server, which is illegal and according to this article there is public corruption charges which could be coming. I wonder when it all boils down, who is going to have to fall on their sword to save Hillary.

Of course Hillary says that the investigation of public corruption charges are completely untrue but how would she know? Are they keeping her updated with the investigation as it progresses?

At this point, Hillary, Trump, or Cruz would be infinitely better than Rubio...Fuck that Rubio, flip flops on everything, sells himself out to highest bidder, doesn't show up to work, damn neocon, and a complete sleaze ball.

If I was a GOP voter, I'd be pretty pissed at the GOP party as they haven't done anything for the average GOP voter.

Last major thing they did was that budget deal that increased the deficit by $800 billion the next decade with its giveaways to all sorts of industries.

The GOP party bitches and complains about the debt and deficit...While they control the power of the purse, guess what they do, they deficit spend.

It doesn't take an education to figure out that the current GOP establishment is useless.

News that the FBI has expanded its probe of Hillary Clinton to include “public corruption” involving the Clinton Foundation is a massive step forward in the investigation of possible corruption involving the Clintons.
It’s no longer about emails. It’s about money and possible payoffs during her tenure as Secretary of State.

I take note that according to Catherine Herridge, the FBI began this track of its investigation of Hillary Clinton in April 2015. That of course just happens to be as my book Clinton Cash was about to be released and was being widely reported by the New York Times, Washington Postand, of course, Breitbart.

The point here is that credible news organizations saw what I saw early on: that there is a clear pattern of money going to the Clintons and the Clinton Foundation around the time that Hillary Clinton was making important decisions that involved those who were sending them the money. As the New York Times confirmed in a 4,000 word front page article, the Clintons bagged some $145 million for the Clinton Foundation from nine shareholders and executives tied to a uranium company that the Russians desperately wanted to buy.

Clinton defenders, including ABC News’ George Stephanopoulos, grilled me and repeatedly said that there was “no smoking gun.” But of course as any prosecutor will tell you, there is rarely a smoking gun. And to suggest that you need one to prove criminal guilt is preposterous. In recent political corruption cases, including former Virginia Governor Bob McDonnell, Senator Bob Menendez of New Jersey, there was no smoking gun. And indeed, there was nowhere near the pattern of financial transactions that exist with the Clintons.

Herridge quotes an unnamed intelligence source as saying FBI agents would be “screaming” if there is no prosecution because “many previous public corruption cases have been made and successfully prosecuted with much less evidence than what is emerging in this investigation.”

Regardless of a person’s politics, a key component of any government is the laws and rules that apply to everyone equally. Why are the Clintons granted a different standard than other politicians, where Republicans or Democrats? Why are they allowed to go places in self-enrichment that others would never dream of?

The FBI will be under enormous political pressure by the Obama Administration to make this all go away. Right now it appears they are not going to play ball with the White House.
