Ok, first of all, the porn stars have the best case against Sheen if they contracted HIV from him. They've just lost all of their earning potential in the industry they work in because a guy knowingly had unprotected sex with them and gave them the condition that makes them unemployable. That's a slam dunk multi-million dollar settlement for any half decent lawyer. Secondly, if he had unprotected sex with anybody and gave them HIV while he knew he had the disease he's going to be liable for damages and really should be prosecutable for reckless endangerment at the least, probably much more than that.
I don't know and/or really care that much either way but they could just argue it should not be considered consensual sex because had he not hidden that serious information from them they wouldn't have given him consent. Either way the law says if you have HIV and don't tell your sexual partners you are committing a crime. It doesn't say they have to contract the disease and they didn't write the law. All they would have to do is prove he didn't tell them. They don't even need to show they got the disease whether they did or not

My question doesn't pertain to any criminal act, it is in regards to the civil suits they are filing against him for monetary damages. Obviously if he infected them they are damaged. If he did not infect them what is their damages?
