The Courts are just about mandated to accept an arbitrators ruling. This Judge, vacated the ruling on the basis that Brady had no prior knowledge that he could recieve a 4 game suspension. The commissioner said the closest thing in the rules they have in regard to cheating was the PED policy, and patterned Brady's punishment accordingly, but the Judge ruled that since there was no specific advance notice, Brady gets to play.
Yeah exactly is a collectively bargained agreement. These judges these days don't know the law from their ass. They make this shit up as they go. Sent from my SM-N910V using Tapatalk
The judge said that you have to have workplace rules that actually exist in order to enforce them, OR that you have to follow the rules that DO exist. You can't just make shit up. Hahahaha!
It was awesome that the NFL took the action to bring this massacre to the very court that demolished them.
That's not what he said. I read the ruling. To claim that Brady had no knowledge that violating the integrity of the game, a priori, is ludicrous, pats troll.
Troy Vincent's testimony showed that Brady did not have that notice. I read it, too. I know this is like losing another AFC Championship game for NYJ fans, but the Judge was as clear as could be...and this was true BEFORE the ruling. The NFL and the haters were just too stupid to heed it.
Yep. I'm sure that the NFL,Brady, and players in general are unaware of Art Schlichter, Alex Karras, and Paul Hornung. Piss up a rope troll. And to the rest of the folks on this thread, when I said the NFL would throw the case, not bringing the gambling/cheating aspect to the court is proof they threw the case.
Berman citing the *Jets cheating, raping The Integrity Of The Game, and getting away with it as a precedent for vacating Brady's suspension is just too awesome. (Pg 31). The specter of Jet Brett Favre's lack of cooperation as a precedent (24) should also make you guys proud. Cheating and obstructing and blazing legal trails for future appeals. HAHAHAHAHAHA!
A (likely futile) attempt at a real discussion... fully recognizing that I have made posts in the past that were not conducive to a legitimate discussion. Here goes: I honestly don't know if Brady did anything at all. What I do know is that nothing was remotely proven to that end. For those that point to the texts and cell phone destroying as proof, I simply ask (and would love to hear thoughts on) the following: If the facts were so clear that Brady was cheating and guilty, then why did NFL go so far out of its way to stack the deck in the investigation, thereby making it both partial and lacking any judicial grounds? Examples: a) Goodell hired an investigator touted as independent, but who was clearly never independent (to the extent that the NFL's own chief counsel played a role in the "independent" report's publishing/editing... this all finally came full-circle when NFL stated to Berman that "there is no requirement of independence"; b) Exponent was hired, a consultant well known for writing advocacy pieces (see: they even once wrote famous report that actually - and with all sincerity - denied that secondhand smoke can cause cancer; c) NFL gave one side evidence that the other side couldn't see; d) The NFL was so concerned what an actually neutral arbitrator would see that they refused the choice to have anyone other than Goodell take this role - if facts were so clear, wouldn't you welcome a neutral arbitrator reaching same conclusion to hammer the point home?; e) Coordinated the appeal decision and the filing in federal court within an hour of each other so you could forum shop; If the case against Brady is so obvious to everyone but a blind-Patriots fan, why go through all these hoops? If the facts are so clearly on your side, why go through such efforts to try and stack the deck? It doesn't make sense. Again, I don't know if Brady had anything to do with ball deflation. I am not saying he didn't. What I do know is that other than blindly spouting an anti-Brady agenda, neither do any of you. And the NFL clearly agreed, based on their trying to steamroll the entire process.
I guess said another way, and more succinctly, if the facts were "so clear", why do all those things that a) make it look like you are jumping through hoops to find TB guilty, and b) in effect, opened themselves (NFL) up to lose the case If facts were so obvious as some would claim, a much more straightforward approach (i.e. welcoming a neutral arbitrator) would have been significantly more effective and likely to prevail in court.
The whole thing really resembled a Monty Python sketch. This is just a random guess on my part, but the heavy-handedness on the part of the league has to have some explanation. This is the entertainment business and its not good to mislead the betting public into thinking the games could be less than fair. So, the league hammers the franchise. Then the league hammers the golden boy QB. Ask yourself why? And ask yourself who in the picture isn't in the picture. Again, just a guess, and I've nothing but a hunch to support it, but my thinking is the league did things this way to send a message to the man behind the curtain.
There is some good to come out of this. That is, Richardson could appeal the suspension and drag things out for the season. Goodell is weak right now and most likely wouldn't put up much resistance. Attack when your enemy is at his weakest.
Thanks for the reply. Your explanation is certainly a possibility. But, strange that the Wells report (written by PW and JP) would go out of its way to exonerate BB then? I honestly think it most likely that: 1) The balls deflated some due to weather, and possibly some due to nefarious means (but there is zero proof it was not just due to weather) 2) Troy Vincent admitted he didn't even know that inflated things (ie tires) deflate in cold weather... which is an astounding admission 3) Once the ball got rolling, Roger, as is his norm, tried to flex his muscles thinking he was empowered to do whatever he wanted... what better way to send a message to the "Union/CBA negotiations in a few years" then going after the golden child. 4) Once NFL headed down this path, they were left with two choices: a) Pull on the brakes once the evidence didn't materialize or b) Push forward, facts be damned... 5) "b" was the choice made and the NFL was all-in before they could do anything to change course
