    how did we get to where we are now with all the wasted time and money in federal appeals court without formally questioning the ball boys?

    Pats fans will tell you that the ball boys have been questioned....just not since the discovery of those text messages.

    It is fairly simple, and a as long as Berman doesn't rule in Brady's favor, just put those equipment people on the stand.

    I cannot see Berman ruling completely in Brady favor...could see a reduction (I think Berman does have the power to reduce the suspension), ..but I think Brady has said that he would not agree to any suspension. So re open and take this case to another court....

    Order those equipment people on the stand, and lay this case to rest.

    This is not true. Wells had all the texts BEFORE they interviewed both of them.

    Yes, but he didn't see or examine the earlier ones until he scrubbed backwards from the January 2015 time frame until 2014.....then he requested Deflator to be re-interviewed based on that. Denied by NE Pats.

    You can't try to even reframe this. Only a guilty party would try to rationalize it.

    If this judge tries to vacate this decision he probably won't be a judge much longer as there is no legal way he can do that. nm, he is probably appointed for life which is how they can do these kinds of things and get away with them.

    I can see Brady appealing and then a year from now retiring if his appeal goes south. It really makes you wonder why he's so steadfast on this and can't accept the penalty. Maybe he thinks admitting cheating could affect his future if true that he wants to run for political office .

    This isn't an appeal, it's a civil suit. The earlier appeal was denied by Goodell before the civil suit was filed.

    If it's a civil suit there is no way in the world the judge can rule for brady as the cba is clearly written.

    Nope. The thing before Berman is a request by the NFL to Federal Court to validate Goodell's ruling of Brady's appeal. NFL punished, Brady appealed, Goodell upheld, then the NFL brought this to court to get it validated, and Brady is fighting that. There is no suit of any type (yet) civil or otherwise.

    So what does that mean exactly, if he validates it it's over with the exception of Brady's appeal. If he does not validate it does that necessarily mean he is invalidating it? Is that even an option for him and if it is on what basis does he have that option?

    I think Berman can 1. uphold the NFL's appeal ruling or, 2. Vacate that ruling (toss it, in other words).
    He could also add things to his ruling- (for example, he could vacate but mandate another arbitration with a neutral arbitrator or something). I think what he CAN'T do is uphold, but change the punishment.

    Also, it is almost a guarantee that whoever loses will appeal, so this will probably outlive us all...

    Berman will come with legal rationale for whatever he does- that will be what's really interesting. IMO, he already broadcast that he will vacate, and he cited the precedent (shadiness by the NFL for withholding Pash as a witness).

    We won't have to wait much longer to hear what Berman says. But this wont be the end

    He can't mandate an arbitrator unless he is ready to throw out the entire CBA which would probably end up in a lockout or strike...it clearly states Goodell has the sole power to rule if he chooses to do so and the union approved it, that is not an option. I suppose he can do anything he wants, that's the problem with these for lifers but it would be stayed in less than 24 hours if he did.
