If you've been following it as you claim, It has been Judge Berman asking the questions of Nash about the evidence in the case. It goes to fairness. BTW, it was Nash who went back and recited Brady's testimony in the case not Kessler. Kessler's points all were about process. I'd love to see Berman kick it back to the league with Tagliabue presiding over it!
You are taking the words of the twitter guys Wallach and Gunn and posting them here. I read it. Kessler is saying process but puts the case in behind his lead in as a huge run on sentence. Nash had to make his points clear by reciting was was decided in penalTy and appeal.
