If they didn't agree with Goddell, this wouldn't be in federal court.
I believe he has already broadcast many reasons that he won't uphold- fundamental unfairness of the process, not making witnesses available, not following the established rules, not imposing discipline that is defined, etc. Regarding the Pash factor (a witness not being allowed to be called without explanation), Berman's words were exactly these: "I believe some arbitration awards have been vacated" (for doing that). Also, "I don't understand the thinking to not allow Mr. Pash as a witness. Who else but Pash had the opportunity to edit the Wells Report?" and, "(The NFL )"cannot just conclude they cannot have a witness because testimony would be cumulative." [all quotes above from various tweets- no transcript is out that I know of] You can either read the above and think that Berman is chastising the NFL to make himself feel better when he actually has to end up supporting them, OR you can read it as I do- a clear message that it would behoove the NFL to settle out of this, because he will NOT uphold and has GIVEN the legal precedent he can pick to do so. I think it was Berman that tried to get Mara involved, to try and talk some sense into the NFL before time runs out. But, that is only my opinion and we shall see soon enough.
That is one reason the Judge would say those things, but he will have the opportunity to say whatever the fuck he wants if/when he has to make a ruling so you have to ask yourself what the purpose of saying it now is.
I think it was Kessler posturing in closed door which requested Berman to ask. The NFL is not on trial here to retry the case. I see the owners agree with upholding the suspension after the appeal turned up Brady's continuing covert cover up. It's 1+1 =2 for most smart people to see.
are you sure on this? my understanding is that this case is not about innocence or guilt, but about procedure, fairness of punishment based on precedent, and the league's authority to punish players as they see fit. so i believe the judge can uphold suspension, reduce suspension, or overturn suspension. there will be no exoneration of Br*dy or the P*ts regardless of outcome, as the judge is not ruling on whether he did it or not. the case is really just a matter of how many games, if any, Br*dy misses, based on the procedures followed, and whether the CBA allows the NFL this authority.

I opined this above. I think he is trying to give the NFL every chance to see how he will rule if he is forced to do so, and that it would be against them. I don't know if Berman cares, but remember that the NFL brought the case to him for validation, so maybe he feels that he needs to diagram for them a little bit. He started hard on the NFL. Then, he got harder on them. Anyway, that is my opinion.

But as Stokes pointed out earlier, his firm was once in the same position the Pats are with this and lost the case. I was speaking with a lawyer friend of mine on the issue and he said the same thing. There is no way to know what a judge is actually thinking until he hands out a ruling. It does look good for the Pats right now that the judge is pushing hard against the league but he also may have already decided to rule with the league and is looking for cracks in the armor to assure himself of his decision. The reality is this could go either way and we should know in a couple weeks.

The term is "more probable than not" and it's the exact thresh hold required to determine guilt. This new thresh hold is a result of the last time the Pats got nailed for cheating (spy gate).
