He was referring to Wells Report Editor and NFL Legal Poobah Pash being withheld. Basically, Berman was coming as close as he could to flat out telling the NFL- fellas, there is no there there. You have no evidence. You have not exhibited basic fairness in the initial ruling, the appeal, of the rules of your league, or of arbitration proceedings. You have brought this to my court, NFL, to validate this ruling. Please put two and two together, gentlemen, and see where this is going to go if you don't change course.

Judge Berman does not sound impressed with the 'evidence' one bit. Has repeatedly asked the NFL to point it out to him. The NFL won the PR war by leaking (bullshit) fake evidence and red herrings. Berman's order to unseal the appeal has shown the NFL to be flat out liars.
Are you sure about that? I know refusing a drug test is considered an admission of guilt and automatic 4 games. I know the old CBA was a $25k fine but did that change? is this held to the same standard as the drug test now is? If so 4 games is spot on. But when you combine the 6 break in protocol, going into the bathroom, the text 7 messages and the science, we felt comfortable 8 reaching a judgment. 9 It was a totality of all of the evidence 10 analysis that gave us comfort in deciding it was 11 more probable than not.
Why would the NFL want to take down one of their most celebrated players for no reason?? You think they wanted this shit to happen? Especially 2 weeks before the superbowl? What positives could the league possibly get out of this whole mess?
What suckbelicheat doesn't admit that the 25K fine is the minimum, but not total amount of fine or punishment for this condition......It's all on the CBA language that Goodell can rule on. I think the NFL fines were light on BRady, but heavy on NE, sans Belicheat allowed to skate unscathed for some other alterior reason.
if the judge feels the evidence is not firm enough (which i disagree with), and the defense has already conceded some obstruction to the investigation, why not get the ball boys + Br*dy on the stand, and put the question of innocence to rest? can't have it both ways......where you obstruct an investigation and then cite insufficient evidence afterwards..
oh it's a good cause for sure, but that equates proportion of wealth to what he could offer. it's like me putting a penny into salvation army collection jar at christmas. It's sad
