Apparently the judge is ignoring the texts between the attendants. In case the judge missed it the Jets weren't playing in the AFC Title Game.

Did they not have tweets/texts from the ball boys that indicated it had been going on at least the entire year? Oh that was before they said they were talking about some absurd other thing altogether.

Now it's Jeffrey Kessler's turn. Brady's attorney. Berman urges him not to respond to Nash's statements to avoid spoiling settlement talks.

I don't think it matters what this guy rules as someone else will rule whether or not it can even be tried as it is totally contrary to the player agreement.

So is Kessler saying that McNally kind of did it on his own. Because it might have been good for his Qb. Jesus H. Christ! I read some legal analysts predictions on what would happen today including one from the Wash Post. They think no settlement because Brady won't accept even a one game suspension. That Berman will make a decision before opening day. And that if not what Brady wants: they will appeal. And the NFL will allow Brady to play until a ruling by the Appellate Court. After that I'm not sure.

I don't think Kessler said they did it on their own. He said it was a possible action. The judge apparently waived off the science explanation because he already understands it (forget where I saw that, someone from inside the courtroom said that Berman didn't need that explanation because it was discussed before the hearing or something along those lines) and wanted to cover all potential avenues, so Kessler said "yes, it's possible this could have also happened."

More on what happened behind the closed doors:

Mike Loyko ‏@NEPD_Loyko 12m12 minutes ago
.@AdamSchefter and Sall said "Berman told the NFL that they better come to grips that a settlement in favor of the NFLPA is very possible"

Mike Loyko ‏@NEPD_Loyko 11m11 minutes ago
.@SalPal_ESPN "Judge Berman basically just said Roger Goodell, you're on the clock"

Matt Stout ‏@MattPStout 19m19 minutes ago
Judge Berman emphasized that despite questioning he hasn't made up mind. "I think there are varying strengths and weaknesses to both sides."

Except for the fact that they have text messages that say things like

"Talked to him last night. He actually brought you up and said you must have a lot of stress trying to get them done…"

"Tom must really be on you "

Kessler is supposed to be the best guy in the business. The best money can buy. But he is asking for the impossible. He doesn't only want a smoking gun he wants a smoking bazooka. It's almost impossible for anyone to deliver the kind of evidence he is demanding. And every bit of circumstantial evidence he is denouncing.

This hearing was about the due process, issues were only brought up as they overlapped in relation to the suspension handed out. It wasn't about the Wells Report findings, just the CBA being followed.

@MikeGarafolo I thought this court case had nothing to do with evidence and only if #Goodell followed rules outlined in the CBA correctly??

    Mike Garafolo retweeted Patrick Cleary

It does but the issues sort of overlap. Expected they would go over some of the stuff again.

Patriots fans are pretty happy about how today went. It's always nice to have a day in court!

    Unless it's for Jury Duty.

Except none of it is based on evidence that he cheated, it's about whether the CBA was followed. It's like most people have always said. It's based on a technicality not because there is some evidence that exonerates Brady.
