First, that's the exact degree of certainty required in the vast majority of non-criminal proceedings. Don't take my word for it. Ask the next lawyer you see. Second, there is an allegation that Brady willfully refused to cooperate and refused to produce evidence. When you do that, any doubts generally don't get resolved in your favor.
