There's no confusion; the rule explicitly says the gloves can have a tacky substance on them. The league tacitly reinforced this when they expressly stated the towels San Diego were using in 2011 (that had a tacky substance applied to them) did not violate league rules.
Gloves CAN have a tacky substance on them but it must be as part of the design of the glove AND approved as being compliant with the National Operating Committee on Standards for Athletic Equipment’s rules and regulations before use. ODB's equipment is therefore correct and above board (unless he decided to spray on an additional and uncontrolled adhesive). Someone deciding halfway through a game to use an oven mitt with double sided gaffer tape applied would be 'gating'

You need both if you don't want * ODB's gloves being NOCSAE approved doesn't make them NFL legal or vice versa but they are the 2 necessary 'qualifications'. The only real confusing issue is just how good JR would be without the advantage he gained? He was pretty good at what he did. The NFL rules allow gloves to have a tacky substance on their surface as long as the substance does not come off the gloves and adhere to the ball - end of story - that's the rule. As long as he was operating within the rules, which he was, I don't really care. It's an uninteresting question to me. The only reason it's even being discussed is because the Cheaties fans are desperate to talk about anything other than their own team's constant cheating.

I beg your pardon but New England came back from two 14 point deficits and were leading by 4 points, which meant Seattle had to score a touchdown. If it weren't for a lucky catch at the 5 this game would have been over sooner. Seattle lost because their defense could not hold two 14 point leads and a defense that allows 37/50 passing in a Championship game sucks! Seattle defense lost that game. Like the Ravens, a bunch of loudmouth, bullsh*tters who can't carry a game.
