    His contract didn't have the standard clause penalizing him for "failure to perform" or show up for practice, and we also have to keep in mind that he was cut before he was even arrested or disciplined by the league. It would be unfair for the Patriots to be able to get their money back for cutting a player who had no criminal or disciplinary proceedings taken against him at the time he was cut. He was being investigated, sure, but that's not the same thing as being arrested.

    I wouldn't think that the CBA would allow a team to get out of a contract just because they think a player will get arrested or suspended, that's really not fair.

    If they wanted to get the money back, they should've waited until he was arrested and weathered the bad press. Can't have it both ways.

    It's not the scouting report of character assessment I'd love to see. Those are probably what we can guess -- good player, questionable ethics.

    It's the psychological evaluation. Unlike character this could give hard fact along the line of "pronounced criminal tendencies". Then the whole "we didn't know" line goes to shit and instead there is a very distinct possibility of knowingly employing a criminal.
    Not the BSPN would ever asked THAT question.

    I'm not so sure about that. Consider the atmosphere of infallibility they lived in. No shadow of doubt about how righteous this organization is. Isn't it possible that a dumb ass Hernandez revealed something more that "I'm in trouble" in a text? Even that "in trouble" would require a team to investigate, right?

    What is investigated? If no, why; if yes, what was found? It's "what did they know and when did they know it", and while I'm obviously speculating, I suspect there might be more than just being duped exposed as a lie.
