what about from the DA/Police perspective? this lady brings me a gun and says it belongs to another person. I cannot prove that the accused person ever possessed the gun within the city, so I cannot prosecute him. but, I can prove that the lady that brought the gun to me did posses the gun within city limits. not only that, simply by the nature of her story she is admitting equally owning and possessing the gun by her accusation that it was her husbands, but not having called the police in the past when they were together. does the DA prosecute her? he can prove the crime.
any real lawyers on this site that can drop some input? Also to one that suggested it was a set up. it sure looks like one. It was best to dial 911 after he point said gun or w/e. But no, as a law student, who brought her simp ass attorney, took the gun out of the house, carried it all the way to the police station, and said it was her husbands who in which she clearly hates. She might have created something that might haunt her for the rest of her life, especially if the gun has a dirty middle man involved.
At a minimum they're going to dust it for prints and track the serial number. If it is Felton's he would stupid to deny it. The better defense is claiming it was never in NYC and have the accuser prove that it was, because as of right now the only person with an illegal gun in NYC is the wife - with a precinct full of government witnesses.
Yeah see thats another thing, he can claim it was from a different state which would kill the NYC charges, would the other state charge him? Prolly not considering the gun is going to be in possession of the state of NY. TBH the defense has a bunch of ways to get out of this, so many holes in this story, especially if Felton had it in a different state.
Maybe she has pictures of the gun in Felton's house/possession. Does that count as some sort of proof?
Depends, because again she can frame the pictures and if the house is in both names, either can get the blame. But let's say his house is in Jersey, they cannot use this as evidence because he is being charged in NY for possession in NY correct? I'm on a tablet, if someone could post the exact charges it would help clarify everything.
The Knicks are going to sign Shannon Brown and Earl Clark to 10 day contracts. Raymond Felton will be available to play Thursday night. His date was moved to June 2nd, a scheduling conflict that will definitely impact the Knicks as they prepare for the NBA finals
