you can make that argument certainly. but if the DA decides to prosecute you, and can show that despite the fact that they were destroying your car that they were posing no threat your personal health (you don't get to defend your car's personal well being and health on its behalf by violent means; if your car decides to strike them down on its own then it would have an easier case to claim self defense), and were only going to destroy your property, and thus you were not justified in using your car as a weapon against them, then you may go to prison for such. you certainly have the right to decide if that is worth the risk, or whether you will just let them destroy your car and let your insurance pay to have it repaired rather than risk being prosecuted and the cost it would take to defend yourself, possible imprisonment, or the worst case scenario -- that they chase you down and nearly kill you for nearly killing them. I think I'd rather let them destroy my car than those three possibilities; that is why I have insurance. unless, of course, they were actually attempting to break into my car to hurt me. but I disagree that it is safe to assume that because they are destroying your car that they are intent on attacking you, especially if they aren't attempting to attack you. obviously you would be frightened in such a situation, but it is not safe to assume they will just go from destroying your car to attacking you if they are not attacking you. and there is no account in the article that says they were attempting to attack him. but, like I said in my previous post, that can't be seen in the video.
It's dumb to even try to defend these bikers. Whoever got ran over got what they deserved. And lol @ thinking "I'd just let them damage my car". I doubt anyone would just sit their without fear for their life and not do anything about it, especially with your wife and kid.
TO THIS ABOVE ^^^, YOU REPLIED WITH THIS PROLIX VERBOSITY BELOW VVV: Lemme sum it up for you JetBlue: I called you out on a totally unfounded, ignorant-of-fact assumption that you posted right out of the box about the driver while referring to him as a "dumbfuck" for good measure. So, let's re-review YOUR VERY FIRST WORDS from your very first post in this thread: No facts = easy for you to deduce? No facts = "dumbfuck in the car probably almost hit one of them." That is a assumption. An ignorant, bereft of fact assumption that can only be bought with the mental currency of a simpleton. Your "complex thought" claims of intelllectual juggling, of cerebral multi-tasking aside (such a 'tangled web' you weave jetblue-lmao!), this all boils down to you making a stupid, perjorative assumption, period. So spare me your rhetorically cloddish attempts at insult; it fails the test of even a mild affront.
The guy has 50 vids on his channel. The police will likely have to go through EVERY single one to find clues.
odds are the cops know who they are. Those videos date back a few years. They ride the highways in a group that big with no fear. It's very strange. Some with no plates, some of the bikes could ever be street legal. in one vid, there is a guy with a girl on back with no helmets. Isnt there a law in NY? They drive right by a cop in the street
you can clearly see the bike purposely get him to bump his back tire. You can also see them off their bikes going to his car. If you watch their other vids, you can see how they ride, they completely ad illegally take over the roads. These guys are clearly a problem and should be dealt with. The guy in the car did nothing wrong by trying to escape the situation with his family.
They drive through all 5 boroughs. Im not sure how they organize but I assume its through a facebook group and they basically get told to all meet up at a certain spot and time. Im sure 90% of them dont even know each other, they just think its cool to waste there parents money on gas because they dont have jobs. If they did they prolly wouldnt spend so much time riding atv's through the boroughs.
I am a biker. The bikers started this shit by riding like prats, over taking , undertaking slow up for no reason and just generally treating the road as their own. I f'n hate these type of power-ranger type bikers, they have nothing but contempt for other road users and most likely throw their legs over their bikes 3-4 times a year, they are not representative. The car driver whilst in the wrong for leaving the scene of an accident, may have had due cause for fleeing. This video COULD be used as defence. The driver may have been fearful of his/her life, there may have also been children in the car. The driver may have had a bad experience from bikers before, we just don't know. Either way, the bikers were more wrong imo than the car driver after taking the law into their own hands. Real bikers ride Harleys
From what I have read it seems that there was the driver, his wife and their 2 year old daughter in the car.
