The handgun charge is much more serious than the possession of the "small bag" of marijuana. He claims the gun wasn't his (of course). But if it can be proven to be his, he's in big trouble. Firstly, in the state of NJ, you have to possess a Firearms ID card. I doubt he has one. And you cannot, under any circumstances, have a loaded gun anywhere in the car. And it is expressly frobidden to have any gun within reach of the driver (console, glove compartment, under the seat, etc). It has to be locked and preferrable in the trunk and of course, unloaded. And the rounds cannot be with the gun. If there is a magazine, the rounds cannot even be in the magazine. Also, you cannot just "joy ride" around with a handgun anywhere in the car even if you obey all of the above laws. You must be going to and from a specific pistol range or gun store for repairs. The law allows for a "reasonable temporary departure from this route," but that would be to go to the bathroom or stop to get something to eat. The route must be directly to and from such an establishment without circuitous deviation from the route. So, riding around on a Saturday night without an ID card and with a loaded handgun in the glove compartment while smoking dope and drinking of all things, is a seriously huge charge. He's broken many laws at many different levels with that one.
