I'm just pointing out that the first amendment does not apply in private gatherings. You have no right to speak your mind in a private space. The proprietors of that space are fully within their rights to expel you from the space and bar your re-entry. Lupe's first amendment rights were not violated by the proprietors of the space and in fact were never infringed upon because he had no first amendment rights in that space.
I would be inclined to agree with your point of view, at least on the grounds of appropriateness and established limitations on the F.A., but the official statement on the incident differs.
They threw some pablum up there about supporting free speech but then they also pointed out that Lupe Fiasco's speech was offending many in the audience and so they expelled him. That's what happens when you stand up in a private venue and begin making noise that people don't want to hear. Put him outside on a soapbox and he's covered by the first amendment and then has to be doing something that violates another law to get suppressed. Based on the description of his performance he might well have been told to move along outside also, as a loud noise repeated at length is usually considered to be disturbing the peace.
