Based on his actions over the last few years the man obviously felt that he was living on his own planet and entitled to do what he wanted to do regardless of the norms and laws in place. The end result is unfortunate and not predictable but definitely not surprising. Money only gets you off if it's old money. New money? That just gets spent on lawyers before you get screwed in the end.
you can't compare 2 different illegal acts in 2 different states. its silly. states have different laws and enforce them differently. in new york, criminal acts involving firearms simply aren't tolerated. period. apparently in florida, if you're not in the crosswalk, even in death, you're screwed. is it fair? no.but its not comparable.
As completely idiotic as it was for Plax to do what he did, 2 years still seems like a pretty hefty sentence. I'm all for letting him get his just punishment for being a bonehead, but it's such a sad commentary on our fucked up system of justice in this country. People get lighter sentences than that for rape and murder in a lot of cases - and much heftier sentences for things as harmless as having a little weed on their person - while we've got rich executives raping the masses through fraud and deception and getting slaps on the wrist. In any case, if a guy like Vick is allowed to come back into the league after what he did, Plax should be welcomed with open arms as soon as he's eligible.
Unless your name if Madoff, who got what, 160 year sentence. Burress is about done anyway. He will miss this year. If he gets time off for good behaviour, he may play next year, but it won't be a full season. By then he is over 34 years old.
Lol - I hear you. Unfortunately, for every Madoff there are a thousand other guys getting away with it. I think Plax is 31 currently which would only make him 32 next season - maybe 33 at the end of the season. I think... someone correct me if that's wrong. Still a bit old for WR, but certainly still feasible that he could have some productive years left.
Two years is too much. I'm surprised he agreed to it and equally surprised his lawyer didn't tell him to hold out and see what the judge hands out. I'd have tried to negotiate for a one year sentence, with 3 months off for good behavior if he agrees to cummunity service. He should miss this season but should be eligible to play in 2010, just MO.
I'm not surprised he took the plea. If you were in a case where you were guaranteed to do some time with no chance of getting off would you really try to shave a year off your time if the downside was thirteen years inside? It's the classic prosecutor's no-lose deal, because they were getting a conviction no matter what. I'm a bit surprised they let him get two years. They probably could have offered him the minimum three and a half and he'd have taken it.
I think 2 years is too much. Trust me when I tell you that I have zero sympathy dfor anyone who carries a loaded gun into a public place like it's the wild west, but 2 years is steep in my opinon. A year in the pokey would have been just fine for the crime.
In most states there is no law against carrying a loaded gun anywhere as long as it isn't concealed without a permit. (Bars are an exception I'm sure..as are opium dens). Just look at all the Obama rallies.
Thirteen years? I thought he was facing three max. I thought I heard Bloomberg said it's a mandatory three-year sentence for carrying a concealed, unregistered hand gun. Of course, it's more than that if you commit a crime with the gun, but that wasn't Plaxico's intent. So I thought the most he was facing was three. Be that as it may, I still think two years is kinda steep. It sounds like the prosecutor was really being a hardass and probably telling Plax's attorney, "Take the 2 years, because he's gonna get 3 if he doesn't accept this deal." Really stupid on Plax's part.
I believe it's 3 for the gun charge, but he could've served far more on related charges like reckless endangerment and the fallout from his hospital fiasco that night. It's just a sad story in general.
He's held out for a damn long time. It's 3.5 years MINIMUM if/when he would have been convicted because he really had no case. He tried for a while to get out of it or to get a better deal. I imagine his lawyer tried to get less than two years... I think he would know what he was doing, at least a little bit.
Yeah he faced 3 and a half to 15 on the combined charges. Again, I think the Prosecutors were generous in this case. There was no way he was doing less than the mandatory 3 and a half if convicted and if the judge was pissed off by the way he defended himself he might well have gotten more. Instead the prosecutors gave him only a little more than half the minimum. It was a good deal. He should be glad he got it. Giuliani would have gone for the throat.
i agree and disagree... while i agree this sentence is harsh and the laws governing this are ridiculous, you cannot draw a comparison on murder and rape to this. also i find it a stretch to say someone who has murdered intentionally receives less then two years. there are many circumstances in which the person does not set out to murder but does...while the outcome is the same the intentions are taken into consideration. of course an armed robbery resulting in a murder doesnt matter whether the person intended to kill or not...but if someone breaks into your house and you murder then with no cue to self defense this is definitly considered. DWI manslaughter is somewhat different as well since the person who did commit to murder did not say...i'm going to drive drunk and murder someone....like i said the outcome is the same but the circumstances are different. rich executives who scam people are not being let off at all....they are receiving 4 years in some cases and in one recent case 150 years. they don't let these guys walk. i think the vick plax comparison is a good one. what vick did was set out to kill dogs and did so violently. vick should have gotten much more time for what he did and i don't think he should be back in the league. watch your beagle vicks an eagle
Theres really no deal to be offered.... in New York City (not new york state), Criminal Possession of fire arm in the second degree (an unlicensed loaded fire arm in this case but could be, carrying 10+ unloaded guns, 1 bomb, shit like that) carries a minimum of a 24 month sentence. On top of that the current New York County DA who is a legend is on his way out the door and was highly unlikely to settle for anything less. Steep? Probably. But that's the law in this town. In 1990, the city had almost 2400 homicides a year. No it's the safest big city in world and averages about 400, which is really an accomplishment considering the population. I actually think this reflects better on the justice system in this town since Mr. Burress is receiving the same sentence as any poster in this room would get for doing the same thing. Seeing how it's not federal time, I bet he serves only 12-14 months in jail and the rest in house arrest. For a first time felon, and with good behavior, that would be pretty standard. Vick on the other hand had to serve the majority of his sentence....
