"Manhattan's district attorney says he wants Giants wide receiver Plaxico Burress to serve time in prison, the New York Post has reported. Robert Morgenthau told the newspaper that Burress, who shot himself with an unlicensed gun in November, was willing to agree to spend a year in jail, but prosecutors insisted on two, the Post said. "We've always taken the position that he's going to have to go to jail, whether by trial or by plea," Morgenthau told the Post for a story in Monday's edition. Burress shot himself in the thigh at a nightclub early on the morning of Nov. 29. He was charged with criminal possession of a weapon and faces up to 3? years in prison. Burress has pleaded not guilty and is free on $100,000 bail. His attorney, Benjamin Brafman, told the Post he was "bitterly disappointed." "Now that they have drawn a line in the sand, this is going to be a battle," Brafman said. I think everyone knew this was going to happen, except for Burress. NYC has strict gun laws and loves to flaunt that they do regardless of celebrity or not. I think it's great. You think you can buy your way out of breaking the law? Maybe somewhere else, but not here.

Even though Stallworth was drunk, The guy that he hit ran out in front of him on a bridge and the guy he hit and killed was drunk aswell. So yes if Stallworth wasnt drunk it might not have happened but if he was sober he probably would have still hit the guy. So it wasnt completely his fault.
It is also a different state and different circumstance than the situation with Stallworth. Mayor Bloomberg made illegal guns in NYC a big platform while running and now has been presented with the opportunity to make an example of his strict crackdown and who better than to prove his point than NFL player with no respect for authority. Burress is lucky he shot himself and not someone else at the club or he would have been looking at 10-15 years like the rapper Shyne got for a similar situation a few years back.
Burress deserves what he gets. Pierce won't get out of this unscathed, but I would be VERY surprised if he ended up serving any jail time.

The guy got terrible legal advice. He should have taken whatever offer was first given to him. the 90 days in jail + community service stint. Whoever told him to test his luck failed.

stallworth 30 days in jail for a dui which resulted in a death as mentioned. gotta love the justice system in the usa.
This was already outlined above.... listen I've got no soft spot for guys who drive over the limit but it was clearly a different situation than most DUI cases. Most DUI's aren't killing people who are also legally drunk. Like was stated Stallworth may have killed the guy if he was drunk or not. He ran out in front of the car, it's not like Stallworth drove up on the sidewalk in South Beach and started mowing people down. As far as Plax... I've heard at a min he is serving 3 1/2 years..... say goodbye NFL. That puts him at or around 35 when he gets out. That doesn't even include any suspension the NFL handed down.
